This course deals with the theory and practice of international commercial arbitration and the fast-growing area of international investment treaty arbitration. The course equips students to counsel clients regarding framing dispute resolution clauses in commercial cross-border contracts; management of international arbitral proceedings; and ancillary judicial proceedings seeking to compel, vacate, stay or enforce arbitral proceedings and awards. Students engage in a practical skills-based exercises and will consider significant international law and public policy questions, along with complex commercial dispute resolution issues and damages considerations. Guest lecturers from the world of international arbitration and commercial dispute resolution occasionally will visit as guest lecturers, affording students insights into current, practical live-case problems. Grading is based upon classroom participation, written submissions as assigned, and a final take-home exam.

This upper-level substantive course introduces the theory and practice of international commercial arbitration and investment treaty arbitration. Students will also draft documents and engage in advocacy exercises related to this practice area and meet guest lecturers who practice in this field.
