Wills, Trusts, and Future Interests
This course presents law governing: the disposition of property under state statutes of succession and by will (including the preparation, execution, and revocation of wills; testamentary capacity; fraud; fiduciary duties, and select topics in estate administration). This course also presents law governing the theory and practice of trust law (including types of trusts; the creation, alteration, and termination of trusts; the trustee).
This upper-level substantive foundational course deals with the laws and practice associated with the disposition of property under state statutes of succession and by will. This is one of the four upper-level gateway courses of which all students are required to complete 2 or 3 (depending on one's position in the class) for graduation. Material presented in this course is tested on the New York Law Exam, Multistate Bar Exam and Multistate Essay Exam.
